§1 Scope
These General Terms and Conditions apply to all orders placed via email with Julien Meisenzahl for the purchase of digital sheet music.
§2 Conclusion of Contract
By sending an order via email, the customer submits a binding offer to purchase the specified digital content. The contract is concluded once the customer has expressly consented to the immediate commencement of performance and the sheet music, along with the invoice, has been sent via email.
§3 Prices and Payment
All prices are stated in euros. In accordance with § 19 of the German VAT Act (UStG), no VAT is charged (small business regulation). Payment is made by bank transfer to the account specified in the invoice.
§4 Delivery
Delivery is made exclusively in digital form via email to the address provided by the customer, after the required consent to the early commencement of the contract has been received.
§5 Right of Withdrawal
For digital content, the statutory right of withdrawal (§ 356 (5) BGB) expires once the customer has expressly agreed that performance of the contract shall begin before the withdrawal period has expired and has acknowledged that this results in the loss of the right of withdrawal. This consent is obtained prior to delivery and may, for example, be included in the customer’s order email.
§6 Copyright
The delivered sheet music is protected by copyright. Reproduction, distribution, or modification without express permission is not permitted. Public performances may be subject to licensing by GEMA.
§7 Liability
The provider is liable for damages caused by slight negligence only in the event of a breach of essential contractual obligations (cardinal duties). In such cases, liability is limited to foreseeable damages typical for this type of contract.
§8 Final Provisions
The law of the Federal Republic of Germany applies. The place of jurisdiction is the provider’s place of residence, provided the customer is a merchant or has no general place of jurisdiction in Germany.
